By accessing or using MeritBoard ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. MeritBoard is operated by MeritBoard LLC ("Company", "we", "us", or "our").
2. Description of Service
MeritBoard is an AI-powered contest platform designed for K-12 teachers to organize, judge, and share student contests in photography, visual arts, and other creative categories. The Service uses artificial intelligence to evaluate student submissions and generate rankings.
3. User Accounts and Eligibility
3.1 Teacher Accounts: You must be 18 years or older and a K-12 educator to create an account. You are responsible for maintaining the confidentiality of your account credentials.
3.2 Student Data: Teachers using the Service agree to comply with all applicable laws regarding student privacy, including FERPA and COPPA. You represent that you have obtained all necessary permissions from parents/guardians before uploading student work.
3.3 School Email Verification: Teacher accounts require verification via a school-issued email address.
4. Subscription Plans and Payment
4.1 Free Trial: Limited to 30 students and 3 completed contests (lifetime). No payment required.
4.2 Pro Subscription: $19/month or $179/year. Includes up to 150 students and unlimited contests per month. Subscription auto-renews unless cancelled.
4.3 Payments: Processed securely through Stripe. You authorize us to charge your payment method on a recurring basis. Refunds are issued at our discretion.
4.4 Cancellation: You may cancel your subscription at any time. Access continues until the end of the current billing period.
5. AI Judging and Contest Results
5.1 AI-Generated Results: Contest rankings are generated by artificial intelligence (OpenAI Vision API) based on criteria you provide. While we strive for accuracy, AI results are subjective and not guaranteed to be perfect.
5.2 Teacher Override: Teachers may adjust AI-generated rankings at their discretion.
5.3 No Warranties: We do not guarantee the accuracy, fairness, or appropriateness of AI judgments. Use results as a tool, not as definitive assessments.
6. User Content and Intellectual Property
6.1 Student Submissions: You retain ownership of all student work uploaded to the Service. By uploading content, you grant us a limited license to display, process, and analyze submissions for the purpose of providing the Service.
6.2 Public Results Pages: Contest results may be shared via public URLs. You control visibility settings and are responsible for what you choose to make public.
6.3 Prohibited Content: You may not upload content that is illegal, offensive, infringes on intellectual property rights, or violates student privacy laws.
7. Privacy and Data Protection
Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
8. Acceptable Use
You agree NOT to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to our systems
- Upload malicious code, viruses, or harmful content
- Impersonate another person or entity
- Scrape, copy, or reverse-engineer the Service
- Share student data without proper authorization
9. Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms, non-payment, or any other reason at our discretion. Upon termination, your access to the Service will cease, and we may delete your data after a reasonable grace period.
10. Disclaimers and Limitation of Liability
10.1 AS-IS Service: The Service is provided "AS IS" without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free operation.
10.2 Limitation of Liability: To the maximum extent permitted by law, MeritBoard LLC shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless MeritBoard LLC from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.
12. Changes to Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.
13. Governing Law and Disputes
